This Technical Note critically analyzes Provisional Measure No. 1,318/2025 , which creates the Special Tax Regime for Data Center Services in Brazil (REDATA). The document examines the environmental, energy, territorial, and regulatory impacts of the expansion of this infrastructure in the country, highlighting the risks of a model based exclusively on tax incentives, without robust criteria for sustainability, transparency, and socio-environmental justice.
